Welcome to EDITION STEINGRÄBER
§ 1 General
The following General Terms and Conditions of Trade are applicable in the version valid at the time of ordering to each and every transaction concluded or entered online as represented on the website www.steingraeber-musikverlag.de between the Steingräber Musikverlag (Steingräber Verlag) and the customer.
§ 2 Conclusion of Contract
The description of our product range is for the benefit of the customer in terms of providing information. It does not constitute an offer for the conclusion of a contract according to § 145 BGB. This does not, at this point, result in a contractual obligation for the Steingräber Musikverlag. By ordering, the customer makes an offer for the conclusion of the contract. The Steingräber Muisikverlag can accept this offer within two weeks by delivering the ordered goods. In case of any unclarities concerning the order the Steingräber Musikverlag will contact the customer by e-mail or telephone.
§ 3 Shipping Costs
Within Germany free shipping on orders of € 25 or more.
Orders of below € 25 shipping rate is € 1,45 per copy.
Shipping rate for more than 1 copy is € 2,50.
Subsequent deliveries are free of charge.
Standard delivery abroad (Europe) is € 4,50.
Delivery outside Europe: information available on request.
§ 4 Payment Due Date and Payment of Purchase Price
The purchase price is payable upon conclusion of the contract. Shipment will be delivered against invoice.
§ 5 Rentention of title
All goods delivered will remain property of the Steingräber Musikverlag until full payment is made.
§ 6 Warranty and Liability
The Steingräber Musikverlag warrants for defects of goods at the time of delivery within the statutory warranty period. In case of a delivery of goods containing defects or damages the Steingräber Musikverlag has the right to make a replacement delivery with non-defective goods or to repair the defect or damage. Should this fail, the customer has the right to cancel the contract or reduce the purchase price.
§ 7 Return of Goods
The customer may return the received goods without statement of reasons within a period of two weeks by sending them back. This period does not begin until the goods have been received. Costs for reshipment are paid by the customer. In case of cancellation the Steingräber Musikverlag will restitute any payment made by the customer. In case of repayments made to a foreign account transfer fees will be deducted. In case of a deteriorated condition of goods the customer may be liable for compensation for lost value. This does not apply if the deterioration of the product is due to its inspection – as would have been possible in the store.
§ 8 General Provisions
The legal relationship between the parties is governed by German Law. The application of the of the UN-Purchasing Convention on Contracts for the International Sale of Goods (CISG) is excluded, even when orders are made from or shipments are made to a foreign country. If the customer has no residence or regular address in Germany, Offenbach am Main shall be the sole place of jurisdiction for all claims pertaining to their order. In case one or more stipulations of this contract including the present provision are, entirely or in part, deemed ineffective or become invalid, or should the contract contain omissions, this does not affect the general validity of the remainder of the provisions or parts thereof. For puposes of interpretation of the contract, the German version of these GTC is the only binding version. The English version is a non-binding translation of the German GTC.
